The sale purchase contract in our online store

 

I. INITIAL PROVISIONS

1) Here we define the relationship between you, our customer, and our online store Perfumes World Online, when you establish a sales contract with our company: Perfumes And More S.L.U., with VAT number B56925217 and registered office at Plaza Miraflores, Tower 7, Floor 2, Door 2, CP29600, Marbella, Málaga, Spain, as the seller and operator of perfumesworldonline.es

2) These Terms and Conditions of Business apply to all our customers, as we offer our services and benefits in the same way to everyone, whether consumers or not.

3) These Terms and Conditions apply to the purchase of products in our online store and also, if applicable, to the purchase of products through the Customer Service line we offer on the website.

4) Once you have selected the product(s) you wish to purchase, the online order is placed when you click the "Proceed to Checkout" button if you are within the shopping cart. Alternatively, from the pop-up window from the basket icon, you will see the "Proceed to Checkout" button. Finally, there is the button called “Order with an obligation to pay” at the end of the checkout process. The commercial conditions and order details are retained for a maximum period of 6 years (art. 30 point 1 of the Commercial Code, Spanish Law). If incorrect data is included in the order, you can edit it through your customer account, or request corrections by emailing info@perfumesworldonline.es.

II. CONCLUSION OF THE SALES CONTRACT

1) You can conclude a sales contract with us remotely through the online store or our Customer Service line.

2) The order you place through our website or through the customer service line will be considered a draft sales contract. It will be valid for 7 natural days, and we will confirm its receipt by email. The sales contract will be concluded when we accept the draft by sending the products you have ordered. We will inform you of the shipment of the products by email. If you register as a customer, you can track your order in real time from your Customer Account - very easy!

3) As an online retail store, we only supply products in normal quantities for household or domestic use. In cases of special discounts or clearances, we have the right to specify the maximum quantity to supply.

III. WITHDRAWAL WITHOUT REASON

1) By law, you have the right to withdraw from the contract concluded in our online store or through the customer service line, without giving a reason, within a period of 14 natural days from the delivery of the products (art. 102 Law of consumers and users, Spanish Law).

2) If applicable, you must inform us of your decision to withdraw from the commercial contract within 14 natural days from the date you received your order. The best way to do this is by contacting us through our email info@perfumesworldonline.es or calling +34 624574176. If you are registered as a customer, you can do so from your Customer Account - very easy!

3) If you withdraw within the aforementioned period of 14 natural days from the delivery of the products, we will refund you the purchase price of the products plus the shipping costs for the amount corresponding to the lowest-cost delivery method offered. The refund will be made as soon as possible once we have received the returned products and have checked their condition. For the refund, we will use the same payment method you used to pay the purchase price, unless we agree otherwise.

4) Without delay, you must return the products within a maximum period of 14 natural days from the date of receipt of the products at your home. If, in relation to the formalised contract, any free item (a "gift") is included, it must also be returned. If not, we have the right to delay the corresponding refund until we receive said gift. In that case, you must pay the shipping costs for that return.

5) By law, you do not have the right to withdraw from the contract in the case of products that you have removed from their packaging, as the item to be returned must be unused, unopened, and in its original undamaged packaging, including the unopened cellophane wrapping. Nor is it possible to withdraw from the contract if you have requested the customisation service of a product or a special gift wrapping, because the item has already been customised or wrapped, and thus the service has already been provided.

IV. COMPLAINTS

1) We will be happy to answer any questions regarding your complaint at info@perfumesworldonline.es or by calling +34 624574176 or from your Customer Account, once registered as our customer.

2) We will inform you of the progress of your complaint, particularly its receipt, acceptance, or rejection, by email or text message. We may also contact you by phone.

3) If the products have any defects at the time of delivery, we may agree to compensation in the form of a voucher. You will also have the right to demand the removal of the defect by the delivery of a replacement product. If the removal of a defect is impossible or unreasonable for us, you will have the right to claim a discount on the purchase price, and if the defect is substantial, you may also withdraw from the sales contract.

4) Products will be considered defective, in particular, when they do not have the usual or presented properties, do not fulfill their purpose, do not comply with legal requirements, or have not been delivered in the agreed quantity (ml). Please note that an allergic reaction to the supplied products cannot be considered in itself a defect of the products. Likewise, deficiencies in gifts and other free services that we provide separately from your order do not constitute a defect. The product images on our online store are for illustrative purposes only and do not constitute a binding representation of the properties of the products (for example, the packaging may differ due to a change made by the manufacturer).

5) We will make a decision on the complaint without delay. The complaint process, including the removal of the defect, will normally not exceed 30 days. If it does, you will have the right to withdraw from the sales contract. You must provide us with the necessary assistance to meet the aforementioned time limit.

6) In the case of a justified complaint, we will bear the return costs of the products.

7) The entity responsible for out-of-court procedures in case of conflict or the entity that manages customer complaints is the Spanish Consumer Agency. If you want more information on how to process a complaint, you can find information here.

V. METHOD OF PAYMENT AND DELIVERY

1) You can select the payment and delivery method from the options we offer. If you choose the payment method with a card, you agree that the amount to be paid will be deducted from your payment card directly at the time of the transaction.

2) The delivery methods with their prices and the payment methods currently offered are detailed and available for your choice when you are in the shopping cart, within the order request form, at point 3. Shipping Method and at point 4. Payment, respectively.

3) The delivery times indicated are approximate and are based on the delivery times provided by the carriers.

4) We reserve the right to provide the service of delivering the products free of charge in selected cases.

VI. DISCOUNT COUPONS AND SPECIAL PROMOTIONS

1) Occasionally or in specific situations, we offer our customers various discount vouchers, gift vouchers, and other types of promotions. Their use is governed by rules that we will inform the customer about in each specific case.

2) Unless otherwise stated, each discount or gift voucher can only be used once, and only one voucher of the same type can be used per purchase.

3) Unless otherwise stated, discounts cannot be combined.

4) If the value of the gift voucher exceeds the total value of the purchase, the difference will not be transferred to a new voucher or refunded.

VII. GENERAL INFORMATION

1) According to the Sales Record Law, it is our obligation to provide you with a receipt for your purchase. We are also required to register online sales with the Spanish tax authorities, in case of technical failure, no later than within 48 hours.

2) The commercial contract between our company and our customers is concluded in Spain and is governed by Spanish laws.

3) All product and service prices are provided including the applicable VAT at the time of placing the order. If the VAT rate changes before the conclusion of the sales contract or before the products are shipped, the customer will be obliged, taking into account the chosen payment method, to settle any insufficient payment of the purchase price, or we will promptly send the customer an email requesting where they can pay any over-payment of the purchase price.

4) By placing the order, you agree to receive the invoice in electronic format. The invoice will be sent by email when the order is dispatched. If you wish to receive the invoice in paper format, please write us an email or send us a message through your Customer Account, and we will send it to you along with the product.

5) All product prices in our online store, including special discount prices, are valid until further notice or until stocks are exhausted.
